This policy explains how Nightmakers handles personal information when you visit our website, contact us or submit an enquiry through one of our forms.

Nightmakers is a Melbourne-based after-dark place-performance consultancy. In this policy, “Nightmakers”, “we”, “us” and “our” refer to the operator of the Nightmakers business and website.

2. Information we collect

Depending on how you interact with us, we may collect:

  • your name, email address, phone number and other contact details;
  • your organisation, role, location and relevant business information;
  • information you provide about a project, challenge, objective or potential engagement;
  • correspondence, meeting notes, proposals, contracts and service records; and
  • limited technical information processed when you use the website, such as an IP address, browser or device information, requested pages and timestamps.

Please do not send sensitive personal information unless it is genuinely necessary and we have agreed to receive it.

3. How we collect information

We generally collect personal information directly from you:

  • through the contact form on this website;
  • through a Nightmakers lead form on Facebook or Instagram;
  • by email, telephone, social media or in a meeting; or
  • when you request information, a proposal or our services.

We may also receive relevant professional information from a colleague who refers you to us or from a publicly available business source. The website and its hosting and security providers may automatically process limited technical information needed to deliver and protect the site.

4. Why we use information

We may use personal information to:

  • assess, respond to and follow up an enquiry;
  • understand a potential client’s needs and determine whether Nightmakers can help;
  • prepare proposals, enter into engagements and deliver our services;
  • manage client relationships, administration, accounts and business records;
  • operate, secure and improve our website and services; and
  • comply with legal obligations and protect our rights or the safety of others.

Submitting an enquiry does not subscribe you to a marketing list. If we introduce marketing communications, we will provide a clear way to opt out.

5. When we share information

We do not sell personal information. We may disclose it only where reasonably necessary to:

  • service providers that support our website, form delivery, email, document storage, communications or business administration;
  • Meta Platforms when you choose to use a Facebook or Instagram lead form;
  • contractors or professional advisers who need the information to assist us and are expected to handle it confidentially;
  • another party with your consent or at your direction; or
  • government, regulatory or law-enforcement bodies where required or authorised by law.

Our website contact form currently uses FormSubmit to route the information you enter to our email account. Email and other communications may be handled through Google services.

6. Overseas processing

Some providers we use, including Google, Meta, website-hosting and form-delivery providers, may process or store information outside Australia. Likely locations include the United States and other countries in which those providers or their infrastructure operate. Provider locations can change, so it is not practicable for us to list every country.

Where Australian privacy law applies, we take reasonable steps appropriate to the circumstances when using service providers that handle personal information.

7. Storage, security and retention

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. These steps may include access controls, account security and reputable service providers. No transmission or storage system can be guaranteed to be completely secure.

We retain personal information only for as long as reasonably needed for the purposes described in this policy, to maintain necessary business and legal records, or to resolve a dispute. When information is no longer required, we take reasonable steps to delete or de-identify it, subject to legal requirements and routine backups.

8. Access, correction and deletion

You may ask what personal information we hold about you, request a correction, or ask us to delete information we no longer need. Contact ryanpaterson008@gmail.com. We may need to verify your identity before acting on a request and may retain information where required by law.

9. Privacy concerns or complaints

If you have a privacy concern, email us with enough detail for us to investigate. We will acknowledge the concern and aim to respond within 30 days.

Where the Privacy Act 1988 (Cth) applies and you are not satisfied with our response, you may be able to contact the Office of the Australian Information Commissioner.

10. Third-party sites and policy changes

Our website may link to third-party websites or platforms. Their privacy practices are governed by their own policies, not this one.

We may update this policy when our services, providers or legal obligations change. The current version will remain available on this page with its latest update date.
